Workers’ Compensation

State law mandates that employers must offer workers’ compensation coverage to their employees. Workers’ compensation is the insurance that protects employees in the event that a worker becomes sick, injured, or dies because of a work-related situation or circumstance. However, benefiting fully from this coverage is not always easy. It is important that you speak with a workers’ compensation lawyer who understands the complicated legal issues involved and can help you.

Some Reasons Why, If You Have Been Injured On The Job, You Would Want The Help Of An Attorney To File Your Workers’ Compensation Claim:

  • You were injured while at work and the company’s insurance company rejected your claim.
  • Your company’s insurance company will not pay for all of your medical expenses.
  • The insurance company is offering you a settlement and you have not spoken to an attorney to find out whether the settlement amount will cover all of your costs.
  • Your employer or insurance company wants to change or terminate your compensation benefits.
  • Your employer has suggested that you return to work and perform a modified version of your responsibilities that can accommodate your injuries. An insurance company may deny your workers’ compensation claim if your job description has now changed and you are able to fulfill all of your redefined responsibilities.

John M. Kenney, P.C. helps employees who have been injured on the job obtain compensation for lost wages and medical benefits. Our clients have included accountants, administrative assistants, construction workers, carpenters, electricians, and many others who have been injured while doing their job. If you are someone who has lost a loved one due to a work-related injury or illness, we may be able to help you claim death benefits under the employer’s workers’ compensation plan.

Workers’ compensation covers most injuries that occur while an employee is performing a job. An injury may occur from a one-time accident, like a fall at the office or exposure to a hazardous spill at a construction site. Carpal tunnel syndrome, caused by repetitive stress, or back problems, caused by sitting in a chair for too long, are two other examples of work-related injuries. A heart condition or chronic stomach problems due to pressures at work might also be reasons to file a workers’ compensation claim.

If, however, an employee was injured because he or she was engaging in illegal activities while at work, such as consuming alcohol or drugs or committing a crime. or the injuries sustained injuries at work were self-inflicted, the worker may not be able to receive workers’ compensation benefits. Also, although most workers are eligible to receive benefits for their injuries, each state may have different rules regarding which employees qualify and which workers are exempt from workers’ compensation. A workers’ compensation attorney can let you know whether you have grounds to make a claim. Even if your employer and their insurance company is going to provide you with compensation, you will want to make sure that you receive the appropriate percentage of wages allowed in your state for your injuries.
